10 בארה"בב הפ דרלי החוק הערכת הצעות במכרז לפי (המשך...).3 מגבלות לשיקול דעתו של עורך המכ רז לפי FAR סעיף קביעת מחיר כמדד הערכה (למעט שרותי אדריכלות ותכנון הנדסי). 2. קביעה של מדד איכות נוסף (לפחות אחד) כמו ביצועי עבר, התאמה לדרישות סף, מצוינות טכנית, יכולת ניהולית וכישורים אישיים. 3. קידום פעילות עסקים קטנים על פי קריטריונים קבועים מראש. 4. שימוש במדד של ביצועי עבר עפ"י הגדרות קבועות מראש, בהם מדד זה אינו רלבנטי. למעט מקרים 5. חובת שקיפות בפ ני המציעים של מדדי ההערכה. שיטת הניקוד לא תיחשף במלואה, אך תוסבר בקווים כלליים. לסיכום: לעורך המכרז בארה"ב יש מעמד מוגדר עם סמכויות וחובות בקביעת מדדי האיכות.
11 ההשלכות של הקושי במדי ד ת האיכות.4 הג דר ה לקויה של המכרז ובעיקר של מד די האיכות הרלוונטיים תוך הסתמכות על גורמים בלתי מקצועיים בעריכ ת המכרז. התעל מות ממרכיבי איכות ושימוש מופרז במדדי מחיר. נטייה להרבות בפטורים. פגיעה בתחרות באמצעות הגדרה איכות. "גמישה" ומלאכותית של התעל מות מהמחיר האמיתי של המכרז- התייחסות לטווח קצר בלבד. יצירת נזק כל כלי למשק במסווה של "מכרזים הוגנים".

13 6. מסקנות ביניים 1. לפעול ברוח המוטיב המרכזי במכרז: תחרות כלכלית. 2. לאמץ את גישת האיחוד האירופי של "היתרון הכלכלי המירבי". 3. לנסח במכרזים את כימות האיכות באמצעות גורמים מקצועיים תוך שימוש במדדי הערכת איכות כ- Credit Scoring להערכת איתנות פיננסית, ותקני ISO מקובלים. 4. להקים מאגר מידע מצטבר שירכז בין השאר, משוב על פעילות הספקים. 5. לעודד התייעלות ע"י הנהגת תמריצים של התחלקות ראויה ברווחי ההתייעלות, ו/או חיוב של קיום תהליכי התייעלות כדרישות סף או כאמת מידה. 6. לעודד שימוש מוגבר באינטרנט כדי להשיא יתרון כלכלי באמצעות שוויוניות, פומביות ושקיפות. 7. השגת השפעות כלכליות חיצוניות במכרזים, כגון שמירה על איכות הסביבה ועידוד עסקים קטנים.
